Terms & Conditions
All orders are accepted and executed on the understanding that the Purchaser is bound by the following conditions of sale, which shall constitute a binding contract, except where specifically varied in writing. In the event of the customer’s order containing conditions contrary to these conditions of sale they are not accepted without written consent from the Company. The word "Company" in the following clauses means Football America UK Ltd. The phrase "our web site" refers to www.footballamerica.co.uk.
1.1 Orders placed via our web site will be treated as firm orders and processed accordingly. Requests for quotations must be made by email, fax or telephone.
1.2 Unless confirmation of telephone orders is clearly marked on the official orders the Company will accept no responsibility for duplication of despatch.
2.1 Prices shown on our web site are in UK Sterling. Changes in quantity may affect price. The Company reserve the right to vary prices without notice and to charge the Purchaser the price ruling at date of despatch. All prices on product pages are shown inclusive of VAT which will is charged at the appropriate rate. Our VAT Number is 921898883 .
2.2 Web site prices may vary from issued price list prices, where a price is lower on the web site, the lower price only applies to orders placed and processed via the web site.
2.3 If, by mistake, we have under priced a product, we will not be liable to supply that product to you at the stated price, provided that we notify you before we despatch the product to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the product at that price. If you decide not to order the product, we will give you a full refund on any amount already paid for that product in accordance with our refund policy.
2.4 For certain promotions and/or starter pack discounts we show discount voucher codes which can be applied within the shopping cart section of our website. If these voucher codes are used in with a selection of products that is not advertised or certain required products are missing from the order, we reserve the right the cancel your order and issue you with a full refund.
- Discount vouchers are only valid for orders placed online.
- Misuse of a discount voucher which has not been given for public or consumer use will result in the cancellation of your order.
- Misuse of a discount voucher that wasn't intended for certain products will result in the cancellation of your order.
- Only one promotion code can be used per transaction.
- Discount vouchers are not valid in conjunction with any other promotion.
- Discount vouchers are only valid on specific products while stocks last and may be withdrawn at any time.
- In the event of product returns, refunds will be given for payment used in the original purchase once the discount is applied.
3.1 Every endeavour will be made to maintain delivery dates but no responsibility for later delivery due to circumstances beyond our control will be accepted. In no case shall delay be a ground for rejecting goods or terminating the contract. Items quoted ex-stock for next day delivery are subject to prior sale.
3.2 The Company accepts no responsibility for any consequences, financial or otherwise, for failure of the customer to receive goods at the delivery address provided by the customer.
3.3 Goods delivered by carrier or Royal Mail Recorded Delivery will require a signature to acknowledge receipt of the goods.
If the goods are delivered and appear not in good condition, they must be signed for as received in damaged condition. Unless this is done, the Company will accept no responsibility for subsequent claims in respect of damaged or faulty goods.
3.4 In the event of goods being returned to the Company because of failure by the customer to receive the goods, the customer will be liable for the costs incurred in returning the goods to the Company. No re-delivery will be made until the customer has paid for the cost of a second delivery and reimbursed the Company for the cost of returning the goods to the Company.
3.5 Shortages/Discrepancies: Any shortages/discrepancy with your order must be notified to us within 48 hours of delivery. Outside of this timescale it is deemed that you have accepted the order.
4. ERRORS AND OMISSIONS
No responsibility is accepted for contingencies arising from errors and omissions in data, specifications or prices from our web site.
5. CANCELLATION AND RETURN
If you wish to cancel an order or return an item please call us on 01530 244433 to authorise and log the return. Non authorised returns may be rejected.
5.1 GENERAL RETURNS
We are happy to accept return of goods in their original packaging only, and if in perfect condition and at the buyer’s cost. The original carriage charge if charged will also not be credited, subject to the following...
All sales are final and we do not supply goods on a trial or sale or return basis. However, you are entitled to cancel your order within 7 days from delivery of the goods for a full credit or refund less any applicable delivery costs providing:
A) The goods must be unused* and ‘as new’ in their original packaging including all manuals and accessories and the packaging must be in pristine condition.
Please note: "Unused" means unused, it doesn’t mean opened, used for a few days and then reboxed.
B) Any items with broken security seals or have been unpacked from their original packaging will be deemed "used" and will not qualify for a refund or credit.
C) You must notify us within 7 days from date of delivery of your intention to return the goods IN WRITING (including by email). We will acknowledge this by email and your goods must be received by us within 14 days of this acknowledgement. During this period it is your responsibility to return the goods to us at your own cost and risk. We will not accept any goods back after this 14 day period.
If goods are received back with missing or used consumables or accessories, the cost of the accessories will be charged to you or we may reject the return entirely.
Goods received back in any condition other than ‘as new’ will be returned back to you at your cost or made available for you to collect.
5.2 FAULTY RETURNS
Should an item fail or develop a fault please contact us as soon as possible as many "faults" can be resolved quickly over the telephone.
If the item needs to be returned you must return the faulty item directly yourself. When the goods have been received, inspected and found to be faulty we will despatch a replacement item to you as soon as possible. We cannot accept return of goods that have been dismantled or a self-repair has been attempted.
If the item is not found to be faulty it will be returned to you at your cost.
This returns policy does not affect your legal rights.
Unless claims for shortages or damage are notified in writing to the carrier (by signing for the goods as 'DAMAGED'), and the Company within three days of receipt no liability will be accepted by the Company. In the event of non-delivery the Company must be advised in writing within ten days from placing the order.
Payment is to be made prior to goods being dispatched. We accept most credit and payment cards.
The ownership of the goods shall remain with the Company until such time as all sums owing to the Company whether under this contract or any other contract have been paid.
9. LIMITED LIABILITY
Any liability which we may incur to you in contract or tort (including liability in negligence) arising out of or as a result of:
9.1 Any failure to supply or deliver goods;
9.2 Any delay in delivery of goods;
9.3 Any defect in any goods or service;
9.4 failure of a product to perform where liability for testing for suitability lays with you;
shall be limited to the purchase price of the goods in question. Your statutory rights are not affected.
10. LIABILITY TO THIRD PARTIES
You shall indemnify us in respect of any liability and all losses, costs, charges and expenses which we may suffer or incur by reason of any claim (including for liability in negligence) made by third parties in respect of or arising out of the state, conditions or use of goods (including, without limitations, goods resold to third parties whether or not despatched directly to third parties at your request) or in any other way relating to the goods.
11. FORCE MAJEURE
11.1 These conditions of sale shall be construed in accordance with the laws of England and if any question, dispute or difference shall arise between the parties in respect of their interpretation, the same shall be referred by agreement to a single arbitrator otherwise it shall be referred to arbitration under the provisions also being applicable to the case of reference to a single arbitrator.
11.2 We shall incur no liability for failure to perform our obligations thereunder due to the existence of circumstances which we have not caused and which are beyond our control.
12. LOYALTY POINTS SCHEME
Our Loyalty Scheme is all about helping you get more for your buck!
When you register on our website, you will be automatically registered on the scheme and a loyalty scheme account will be opened for you.
You will be awarded 1 point for each complete £1 that you spend in a single transaction (1 points = £0.01) and these points can be redeemed for future purchases that you make through the site.
The Football America UK loyalty scheme is managed and promoted by Football America UK.
The scheme is valid on the Football America UK web site. It is not valid on any of our Team Store websites.
The points allocated through the scheme are personal to the account holder of the Football America UK website account and the allied loyalty scheme account to which the points have been allocated. They cannot be transferred to any other person or account. Nor can they be sold, or traded in any way.
Football America UK do not accept any liability for loyalty scheme accounts that have been sabotaged due to any actions of the account owner.
In administering the scheme Football America UK will be processing your personal details. Please see our Privacy and Data Protection Policy in order to understand how we do this and your rights
Points will be removed from user accounts if an order is returned and fully refunded
Point will be removed from user accounts when a partial refund has been actioned for a returned item
We reserve the right, at any time without notice, to end the scheme or decline to issue any membership to the scheme.
We can take any action we believe to be appropriate if we have reason to believe that you are abusing the scheme, including withholding points previously credited to your loyalty scheme account
We may modify the terms of the scheme in any way that we choose at any time. Changes to the terms will not affect points that you have already collected. These terms are valid from 2nd March 2016.
13. DEKOPAY FINANCE ORDERS - REFUNDS AND EXCHANGES
All purchases on finance can only be refunded in FULL if the whole order is returned, and received by Football America UK, within 10 days of purchase (DekoPay has 14 day cooling off period). Once your order has arrived back at our warehouse we will cancel your finance agreement. You will receive an email from DekoPay confirming the cancellation and the refund of your deposit.
If you simply require an exchange of a product (of the same value or more), you can do this within 28 days (from the day of received/signed for).
We are unable to process any refunds for orders placed using finance (unless the whole order is returned and cancelled within 10 days of purchase).
14. MAILING LIST SIGN UP
If you have subscribed to our mailing list we may contact you from time to time to provide you with information about our goods, special offers and other information from time to time. You can subscribe to our mailing list at the time of registering your account. You can also subscribe / unsubscribe to our mailing list at any time by going to the "My Account" section of our website.
You can unsubscribe from receiving promotional material from this site by clicking on the "unsubscribe" link contained in promotional emails we send to you.
Even if you are removed from any such list, if you order online, we will send you an email confirming your order and may need to contact you by phone, email, or regular mail if we have questions about your order. in In addition, you should be aware that it is not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons.
All our subscribe options are 'double opt-in' which means all email addresses need to verified before added into our mailing list.
Upon subscribing you will be sent a confirmation link which you need to click to confirm your subscription.
14.1 MAILING LIST 5% DISCOUNT
We may sometimes offer a 5% discount code for new subscribers. This discount code is valid once per customer and is an online discount only.
These discounts are not given to customers or re-sellers that may already be receiving discounts on their purchases, although our advertisements for these offers will still appear.
These discounts cannot be used in conjunction with any other offer voucher code. Code is valid for 30 days.
We reserve the right the cancel your order and issue you with a full refund if we deem the voucher code to be used incorrectly.
